Welcome to The Care First Physiotherapy Service (ABN: 65114676757).

By accessing our website (thecarefirstphysiotherapyservice.com.au), enrolling in the “Spine Resilience Protocol,” or utilizing our Headless LMS and Telehealth platform, you agree to be bound by the following Terms of Service. Please read them carefully, as they govern your legal rights, medical disclaimers, and financial obligations.

1. Medical Disclaimer & Assumption of Risk

The Care First Physiotherapy Service provides clinical-grade kinematics, structural assessments, and digital rehabilitation programs. However, you acknowledge and agree to the following:

  • Not Emergency Care: Our Telehealth services and digital programs are not a substitute for emergency medical treatment. If you are experiencing acute, severe, or life-threatening symptoms, you must contact emergency services (e.g., 000 in Australia) immediately.
  • Assumption of Risk: Physical rehabilitation and kinetic re-engineering inherently carry a risk of injury. By participating in the “Spine Resilience Protocol,” you voluntarily assume all risks associated with the prescribed exercises.
  • No Guaranteed Outcomes: While our protocols are science-backed, human biology varies. Healing depends heavily on your strict adherence to the program. We do not guarantee specific medical outcomes simply by purchasing the program.

2. The Spine Resilience Protocol & LMS Access

Upon purchasing the 12-Week Spine Resilience Protocol ($1,297 USD or agreed payment plan), you are granted a revocable, non-exclusive, non-transferable license to access our Learning Management System (LMS).

  • Account Security: You are strictly prohibited from sharing your login credentials. Our system monitors IP addresses and concurrent logins. Unauthorized sharing will result in immediate termination of your access without a refund.
  • Drip-Feed Content: Course modules and video assets are released progressively to ensure proper clinical pacing. You may not bypass or accelerate this structure.

3. Intellectual Property (IP) Rights

All materials provided within the platform—including but not limited to 1:1 Spinal Audit methodologies, custom kinetic blueprints, Vimeo-hosted instructional videos, PDFs, and UX/UI designs—are the exclusive intellectual property of The Care First Physiotherapy Service.

  • You may not download, record (screen-capture), reproduce, distribute, or create derivative works from our proprietary clinical content.
  • Any violation of our IP rights will result in immediate legal action and platform ban.

4. Payments, Billing & Subscriptions

All financial transactions are securely processed via PCI-DSS compliant third-party gateways (e.g., Stripe).

  • Payment Plans: If you are enrolled in a payment plan, you agree to maintain a valid payment method on file. Failure to process a scheduled payment may result in the automatic suspension of your LMS access and SOS Chat Support until the balance is settled.
  • Chargeback Policy: We actively dispute unjustified credit card chargebacks. By agreeing to these terms, you acknowledge that initiating a fraudulent chargeback is a breach of contract.

5. Cancellation & Refund Policy

We adhere to strict Australian healthcare guidelines regarding appointment cancellations to respect our clinicians’ time:

  • 24-Hour Cancellation Policy: If you need to cancel or reschedule a 1:1 Telehealth session or Spinal Audit, you must provide at least 24 hours’ notice prior to the scheduled time to be eligible for a full refund or penalty-free reschedule.
  • Late Cancellations / No-Shows: Cancellations made within 24 hours of the appointment, or failure to attend a session, will result in the forfeiture of the session or a cancellation fee equal to 100% of the session cost.

6. The 30-Day Pain-Free Guarantee (Conditional)

Our 30-Day Guarantee is an action-based clinical promise. To qualify for a refund under this guarantee, you must demonstrate that you have put in the required work:

  1. You must have completed 100% of the released LMS modules within the first 30 days.
  2. You must have attended the mandatory 1:1 Spinal Audit and Weekly Clinical Rounds.
  3. You must provide evidence (e.g., tracking logs/videos) that you implemented the prescribed kinetic exercises daily. If you meet these criteria and experience zero improvement in your kinetic chain, you may request a refund by emailing our support team.

7. Telehealth & Digital Communications

By using our platform, you consent to receive digital communications from us, including SMS and Email (managed via our CRM infrastructure), regarding your treatment, appointments, and platform updates. You also consent to the use of secure video-conferencing software for your clinical assessments.

8. Limitation of Liability

To the maximum extent permitted by Australian law, The Care First Physiotherapy Service, its directors, and its clinicians shall not be liable for any indirect, incidental, or consequential damages arising out of or in connection with your use of our digital platform or rehabilitation protocols.
